CHANGE IN INHERITANCE: AN ANALYSIS OF THE DRAFT REFORM PROJECT OF THE CIVIL CODE THAT REMOVES THE WIFE/COMPANE FROM THE NECESSARY HEIRDS

Abstract

This scientific work deals with the analysis of the draft reform of the Civil Code of 2002, focusing on changes to inheritance law. Within the family entity, inheritance law is foreseen even before Philippine ordinances. Over time, it evolved according to society's needs, relying on social adequacy. With the general objective of analyzing the draft that modifies the quality of the wife/partner with regard to inheritance, the relevance of the topic lies in an in-depth analysis of the consequences of the possible change in Brazilian inheritance law, going against rights that were conquered through over time by women. At the end of this research, it will be possible to better understand the implications of the ideas contained in the draft reform of the Civil Code, mainly in relation to the situation of the wife/partner, and conclude whether, given the history of family law in Brazil, the wife/partner should be maintained or not as necessary heirs. The methodology used to develop this scientific article is bibliographical research, extracting information from physical books, electronic books, scientific articles, monographs, magazines, and judgments in Brazil on the topic.
